Water District lawsuit final;
Moores did not appeal

Rio Linda/Elverta Community Water District (RLECWD) General Manager
Dave Andres confirmed that the Court ruling on the lawsuit brought by
Gene Moore and Charlea Moore is now final. The Moores, who reside
within the RLECWD boundaries but do not receive water at their
residence from RLECWD, filed suit in February to block salary increases
for RLECWD employees.
The Moore's legal action, which followed a flawed referendum petition,
was denied by Superior Court Judge Raymond M. Cadei on June 6, 2003.
Charlea Moore, who holds elected office as Director of the Rio
Linda/Elverta Recreation and Park District, stated on June 9, "...we
have no choice but to appeal this ruling". However, the Moores did not
do so before the appeal deadline.
Andres, when asked about RLECWD costs imposed by the Moores, said "I am
disappointed at the fact that our rate payers have had to shoulder
these litigation costs even though the lawsuit was brought by
individuals who don't receive water from the District." RLECWD records
show the legal fees alone cost the District $18,429.84.
